Terms of Service

The agreement between you and JobSim. Section 4 is the one to read if you read only one: it sets out what a simulation is and, more importantly, what it is not.

Last updated: 12 October 2026 (version 1.0)

1. Who we are, and what these terms cover

JobSim ("JobSim", "we", "us") is a job-simulation service operated by LEAD Academy (the "Operator"). These terms are an agreement between you and the Operator, and they govern your use of the JobSim website, application and related services (the "Service").

By creating an account, or by using the Service, you accept these terms. If you don't accept them, don't use the Service. Our handling of personal data is described separately in the Privacy Policy, which forms part of this agreement.

You can reach us at [email protected]. The Operator's registered legal name and registered office are stated in every written agreement and invoice we issue, and we will give them to you, to a court or to a regulator on written request. We send notices to the email address on your account, and you send notices to us at the address above.

2. Eligibility and your account

  • You must be at least 18 years old. Under the law of Bangladesh a person under 18 cannot make a binding contract, so we cannot accept younger users. By creating an account you confirm that you are 18 or over and have the legal capacity to accept these terms. If we learn that an account belongs to someone under 18, we may close it and delete its data. An organization that wants to enrol learners under 18 must first agree a separate written arrangement with us (see section 10).
  • The information you give us, including the profile you build during onboarding, must be accurate and yours.
  • An account belongs to one person. Don't share it, and don't use anyone else's.
  • Keep your password and any one-time codes we email you to yourself. You are responsible for activity under your account until you tell us it has been compromised.
  • If you sign in with Google, you also remain bound by Google's own terms for that account.

3. The kinds of account, and what each includes

  • Individual. You sign up yourself. You can build personal simulations for the role you choose (one live at a time, and up to three new ones in any 24 hours), join shared simulations, and receive a summary and credential when a run finishes. We may change these limits, as section 12 explains.
  • Organization-managed. An organization creates and administers your access. Section 10 covers what that means for you in practice, and it is the section to read most carefully.
  • Organization administrator. You create simulations, invite candidates and review their results on behalf of your organization. Your organization is responsible for having a lawful basis to do so, and you confirm you have authority to bind it to these terms.

4. What the Service is, and what it is not

The Service is a training and practice simulation. It generates a fictional company, fictional colleagues and fictional work so you can practise professional communication and task handling, and it produces a readiness score that shows how you performed in that simulation.

To be explicit about what it is not:

  • It is not employment. Nothing in the Service creates an employment relationship, an internship, a work placement or any entitlement to pay, between you and us or between you and any organization using the Service.
  • We are not an employer, a recruitment agency or a job-placement service. We do not find you work, we do not make hiring or admission decisions, and we do not promise that using the Service will lead to any job, offer or interview. An organization that runs a simulation may look at your results as one input in its own process. Any decision it makes is its own, and you should raise it with that organization.
  • Results are not qualifications. Reviews, scores, summaries, readiness reports and the credential issued when a run finishes are generated by software. A credential records that you completed a simulation and the score you reached. It is not a professional qualification, a certification of competence, a reference, or an assessment by a professional assessor.
  • It is not professional advice. Nothing produced inside a simulation, including anything an AI colleague tells you, is legal, medical, financial, career or employment advice, and it must not be relied on as such.
  • Your colleagues are not real people. Every character in a simulation is generated. Do not treat a conversation with one as a conversation with a human being.

5. Acceptable use

You agree not to:

  • Enter real sensitive information into a simulation: payment or bank details, passwords or credentials for other services, government identifiers (such as a National ID, passport or tax number), biometric or health information, or confidential material belonging to a real employer or client.
  • Enter personal data about other real people without a lawful basis for doing so.
  • Use the Service to harass, defame, threaten or discriminate against anyone, or to produce unlawful content.
  • Prompt, jailbreak or otherwise manipulate AI characters into doing your work for you, breaking character, or producing content prohibited by these terms.
  • Spam colleagues or channels, or submit work that is not your own. Pasting into answer boxes is turned off for this reason. Do not work around it.
  • During a final assessment, use another person, device or tool to answer for you, or try to defeat its time limit or its fullscreen rules.
  • Scrape, crawl, reverse-engineer, decompile, or access the Service by automated means, or extract its content to train other models.
  • Probe, load-test or interfere with the Service's security or availability, or attempt to reach data belonging to another user or another organization.
  • Circumvent limits your organization has configured, impersonate an administrator, or misrepresent evaluation results.
  • Resell, sublicense or provide the Service to third parties as your own.

6. Conduct inside a simulation, and how to appeal

A simulation is a workplace, and behaviour is part of what it measures. If you break section 5 inside a simulation:

  • HR in the simulation will warn you, and the warning is recorded.
  • Repeated warnings remove you from that simulation, and conduct counts toward your result.
  • For serious or repeated abuse we may block your email address from JobSim, as described in section 13.

Where an organization runs your simulation, its administrators can see conduct records for their own candidates.

Appeals. If you think a warning, removal, block, withdrawn credential or conduct-based score was wrong, write to [email protected] within 30 days of finding out. A member of our team who was not involved in the original decision will review it and reply in writing with the outcome and the reason. For organization-managed accounts, we can review whether the Service applied its rules correctly, but decisions about your role, your result or your access within the organization remain the organization's (see section 10).

7. Credentials and public pages

When an eligible run finishes, we issue a credential with its own public page. It shows your name, the role, the issuing organization, your score against the pass mark, and when it was issued and expires (one year later). Anyone with the link can verify it, and you may add it to LinkedIn. You can hide it from public view at any time. We may withdraw a credential obtained in breach of section 5, and you can appeal that under section 6.

8. Your content

You keep ownership of what you write, submit and record in the Service. You grant us a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, transmit and process it strictly for the purpose of operating and supporting the Service, including sending it to the third-party processors described in section 9.

This licence exists so the product can function. It does not let us publish your work, sell it, or present it as our own.

We may also use your content in aggregated, de-identified form, meaning it cannot reasonably be linked back to you or your organization, to measure and improve the Service, for example to check that scoring is fair and to detect abuse. We do not use your personal content to train or fine-tune AI models, and we do not permit our AI providers to do so. If we ever want to, we will ask for your separate, opt-in consent first. The Privacy Policy describes this in more detail.

9. AI-generated content and third-party processing

The Service is built on large language models and real-time voice infrastructure. You should understand four consequences of that:

  • Output can be wrong. Generated colleagues, briefs and feedback may be inaccurate, inconsistent, or confidently mistaken. We do not warrant the accuracy of generated content.
  • Scores are advisory. A score is software's assessment of your work in one fictional setting. It is not a final judgment of your ability. You can ask for a person to review a score, as the Privacy Policy explains.
  • Your input is sent to third parties. Your messages, and the audio and transcripts of voice sessions, are processed by external AI and real-time media providers so the Service can respond. Some of those providers are outside Bangladesh. The Privacy Policy names them and explains the safeguards.
  • Output is not unique to you. Similar prompts can produce similar text for different users, so we make no claim of originality or exclusivity over generated material.

10. Organization-managed accounts

If your access was created by an employer, school or training provider, that organization administers it. In practice this means they:

  • configure your simulation: the role, the project, the colleagues, the tasks, its length and how strictly work is reviewed;
  • can view your activity in it, including messages, submissions, reviews, attendance, conduct records and your readiness report;
  • can change, suspend or delete your access and the simulation behind it at any time, which will end your session.

Their own policies apply to you alongside these terms. Disputes about your role, your results or your access must be raised with your organization first. We act on their instructions for organization-managed accounts and cannot override them on your behalf.

An organization that uses the Service agrees that it will give its candidates and learners the notices the law requires, will not enrol anyone under 18 without a written arrangement with us and the verifiable consent of a parent or guardian, will use results only as one input in its own decisions, and is responsible for those decisions.

11. Fees, plans and trials

  • Individuals. The Service is free for individual users at launch. We will give at least 30 days' notice before we start charging for anything that is free to you today.
  • Optional paid add-ons. Some extras, such as a printed certificate, may be paid. The price, any taxes (including VAT where it applies) and the delivery terms are shown before you pay. You can cancel an add-on for a full refund before we begin producing it. Once produced, we refund only where it is faulty or is not delivered. You never enter payment details inside a simulation. Payments are taken through a payment provider on a separate checkout.
  • Organizations. Pricing, billing cycles, taxes, renewal, refunds and what a pilot or trial includes are set out in the organization's written agreement with us. Pilots may be free or discounted on terms agreed in writing. Where an organization pays for your access, you are not charged directly.

12. Availability, changes and beta features

We aim to keep the Service available but do not guarantee uninterrupted access. We may change, add or remove features, and we may run features labelled beta or experimental, which can be unstable and may be withdrawn without notice. Planned maintenance and material reductions in functionality will be notified where reasonably practicable. If we remove a feature you rely on in a way that materially reduces what the Service does for you, you can close your account and we will delete your data under the Privacy Policy.

13. Suspension and termination

You may stop using the Service and close your account at any time, and you can ask us to delete your data. We may suspend or terminate access if you breach these terms, if we are required to by law, or to protect the Service or other users.

Removal for conduct is described in section 6. If we block an email address for serious or repeated abuse, we keep a record of the block for as long as it applies and review it at least every three years, and you can appeal under section 6. Access to a simulation also ends when the simulation does: when its time runs out, when you end a personal run, or when an organization deletes it. You can start or join another from your dashboard. For an organization account only your administrator can restore access. Retention of your data after termination is covered in the Privacy Policy.

Sections that by their nature should continue after termination (including 8, 14, 15, 16, 17 and 19) do so.

14. Our intellectual property

The Service, meaning its software, interface, branding, scenario designs and documentation, belongs to us and our licensors. These terms grant you a limited, personal, non-transferable, revocable licence to use the Service as intended, and nothing more. Feedback you send us about the product may be used without obligation or payment.

15. Disclaimers

To the fullest extent the law allows, the Service is provided "as is" and "as available", without warranties of any kind, express or implied, including fitness for a particular purpose, accuracy of generated content, and any outcome relating to your education, employment or career. Nothing in these terms excludes or limits any right or liability that cannot lawfully be excluded or limited, including your rights under data protection law and consumer-protection law that applies to you.

16. Limitation of liability

To the fullest extent the law allows, we are not liable for indirect, incidental, special or consequential loss, nor for lost profits, lost opportunity, lost data or reputational harm. Our total aggregate liability arising out of or relating to the Service is limited to the greater of (a) the amount you paid us in the 12 months before the claim arose and (b) BDT 10,000.

None of this limits liability for fraud, wilful misconduct, gross negligence, death or personal injury, or any other liability that cannot lawfully be limited. Some jurisdictions do not allow certain limits, in which case they apply only as far as permitted.

17. Indemnity

You agree to compensate us for reasonable losses and costs from third-party claims that arise from your breach of these terms, your misuse of the Service, or content you put into it in breach of section 5. We will tell you promptly about any such claim and let you take part in dealing with it.

18. Third-party services and links

The Service integrates third-party providers and may link to sites we do not control. We are not responsible for their content, availability or practices, and your use of them is governed by their own terms.

19. Governing law and disputes

These terms, and any dispute arising from them or from the Service, are governed by the laws of Bangladesh, and the courts of Dhaka have exclusive jurisdiction. This does not affect any mandatory consumer protections available to you where you live.

Before starting proceedings, both sides will try in good faith to resolve the dispute informally. Write to [email protected] describing the problem and what you want. We will respond in writing and, if it is not resolved, both sides will have 30 days from your first email to settle it before either starts proceedings. Either side may seek urgent court relief at any time to prevent harm. An organization that uses the Service may agree a different process, such as arbitration, in its written agreement with us.

These terms are written in English, and the English version prevails if we provide a translation.

20. Changes to these terms

We may update these terms. For a material change we will give at least 30 days' notice, by email or in the product, before it takes effect. Other changes take effect when posted. The date at the top of this page always reflects the current version. If you don't agree to a change, you can close your account before it takes effect and we will delete your data under the Privacy Policy. If you keep using the Service after a change takes effect, you accept it. A change never applies to a dispute you have already raised with us in writing.

21. General

  • Whole agreement. These terms, the Privacy Policy and any written agreement between your organization and us are the whole agreement about the Service. If an organization's written agreement conflicts with these terms, the written agreement prevails for that organization and its users.
  • If part is unenforceable. If a part of these terms is found unenforceable, the rest stays in force, and we will replace the part with the closest enforceable wording.
  • No waiver. Not enforcing a right straight away does not mean we have given it up.
  • Assignment. You may not transfer your account or these terms to anyone else. We may transfer them to a successor to our business, and we will tell you if we do.
  • Electronic agreement. You accept these terms electronically, and that acceptance is as valid as a signature. We keep a record of when you accepted and which version.
  • Events outside our control. Neither side is liable for a delay or failure caused by events beyond its reasonable control, such as network or power failure, a provider outage, or government action.
